Terms of Service

1. Service description

425 Scheduler is a scheduling and invoicing platform for service professionals (“Pros”). We provide software tools to help Pros manage their clients, appointments, and billing. We are not responsible for the services that Pros provide to their clients, nor do we participate in the contractual relationship between a Pro and their clients.

2. Subscription and payment

Free trial: All new accounts start with a 30-day free trial. A valid payment method (credit or debit card) is required at signup.
Monthly pricing: R300/month (ZAR), €15/month (EUR), or $16/month (USD), depending on your region.
Yearly pricing: R3,000/year (ZAR), €150/year (EUR), or $160/year (USD). Yearly plans offer a discount equivalent to two free months.
Payment processing: All payments are processed by Stripe. 425 Scheduler never stores your credit card details.
Yearly plans: Yearly subscriptions are non-refundable for unused months. You may cancel at any time, but access continues until the end of the paid year.
Cancellation: You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the current billing period. You retain full access until that date.
After cancellation: Your data is retained for 12 months after your subscription ends. You may reactivate your account during this period.
Price changes: We may adjust pricing with at least 30 days' notice. Existing subscriptions are honoured at the current rate for the remainder of the billing period.

3. Data ownership

Pros own their client data. 425 Scheduler acts as a data processor on behalf of the Pro.
We do not sell, share, or use your data for advertising purposes.
On cancellation, your data is retained for 12 months, then permanently deleted. You may request earlier deletion at any time.
You may export your data at any time by contacting us at privacy@scheduler.t425g.com.

4. Acceptable use

You agree not to use 425 Scheduler for:

Any illegal activities or services prohibited by applicable law
Sending unsolicited communications (spam) through the platform
Attempting to access other users' data or circumventing security measures
Reselling or sublicensing access to the platform without our written consent

5. Service availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance, which will be announced in advance via email or in-app notification. We are not liable for temporary outages caused by factors beyond our control, including internet connectivity issues, third-party service disruptions, or force majeure events.

6. Limitation of liability

To the maximum extent permitted by law, our total liability for any claims arising from or related to the use of 425 Scheduler is limited to the amount you have paid us in the three (3) months immediately preceding the event giving rise to the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

7. Intellectual property

The 425 Scheduler platform, including its design, code, and documentation, is the intellectual property of LGH B.V. Your subscription grants you a non-exclusive, non-transferable licence to use the platform for the duration of your subscription.

8. Governing law and disputes

These Terms of Service are governed by the laws of the Netherlands. LGH B.V., trading as 425 Scheduler, is registered in the Netherlands. Any disputes arising from these terms shall be submitted to the competent court in Den Haag, Netherlands.

9. Changes to these terms

We may update these Terms of Service from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated terms.
